A binding nomination has to be signed by you, in front of two eligible witnesses. Nobody can sign one on your behalf — not your spouse, not your EPOA, not your solicitor. If you lose capacity with a lapsed BDBN, the trustee gets discretion. That's why we chase you 47 days out.
